These terms and conditions apply to the Site, and all of its divisions, subsidiaries, and affiliate operated Internet sites which reference these Terms and Conditions. DCmarket is owned and operated under Double Click Global Sdn Bhd, a company incorporated in Malaysia under registration number 1257330-A and we are having its registered address at 11-02, Jalan Ekoperniagaan 2/2, Taman Ekoperniagaan 81100 Johor Bahru, Malaysia.
By opening the Site, you check your understanding of the Terms and Conditions. If you do not agree to these Terms and Conditions of use, you shall not use this website. The Site reserves the right, to change, modify, add, or remove portions of these Terms and Conditions of use at any time. Changes will be effective when posted on the Site with no other notice provided. Please read these Terms and Conditions of use regularly for updates carefully. USE OF THE SITE
We grant you a non-transferable and revocable license to use the Site, under the Terms and Conditions described, for the purpose of shopping for personal items sold on the Site. Commercial use or use on behalf of any third party is prohibited, except as explicitly permitted by us in advance. Any breach of these Terms and Conditions shall result in the immediate revocation of the license granted in this paragraph without notice to you.
Content provided on this site is solely for informational purposes. Product representations expressed on this Site are those of the vendor and are not made by us. Submissions or opinions expressed on this Site are those of the individual posting such content and may not reflect our opinions.
Certain services and related features that may be made available on the Site may require registration or subscription. Should you choose to register or subscribe for any such services or related features, you agree to provide accurate and current information about yourself, and to promptly update such information if there are any changes. Every user of the Site is solely responsible for keeping passwords and other account identifiers safe and secure. The account owner is entirely responsible for all activities that occur under such password or account. In addition, seller or buyer must notify us of any unauthorized use of your password or account. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.
A member must not provide false information when applying for the membership, and in the event of any changes in the information when applying for the membership, the member must update the information immediately. As a general rule, company name, ID and company registration number and the like cannot be changed, unless permitted granted by applicable laws and regulations.
If anything that you submit to the Site and/or provide to us, including without limited to, questions, reviews, comments, and suggestions collectively, “Submissions” will become to our sole and exclusive property and shall not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We can, but shall not be obligated to, remove or edit any Submissions. For any damages arising out of the failure to update information must be borne solely by the relevant Member, and the Company shall not be held liable for any such damages.
Please note that you are not allowed to change your email address once your membership request is submitted and approved as your membership account is linked to the email address. If you would like to change your email address, you will need to terminate your membership and account, and sign up again using the new email address.
To become a Member, Malaysian or Foreigner are must be completed with the following requirements as below:
- If you are Malaysia company seller, you must submit the legal company registration including company incorporation documents and details of personnel handling the Member account.
- The transaction is prohibited by law or these Terms and Conditions;
- The Seller materially changes the Product’s description or the Product does not confirm to the Seller’s description; or
- An error exists in the Product listing information which materially affects the terms of the sale.If you are Foreign company seller, you must submit the legal company registration including company incorporation documents and details of personnel handling the Member account.
ORDER ACCEPTANCE AND PRICING
Please note that there are some cases when an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order for any reason at any given time. You may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the order.If you, in the capacity of a Buyer, place an Order to purchase a Product on the Website and the Order is accepted by the Seller, you are obligated to complete the transaction with the Seller and to be assured by such additional terms and conditions specified by the Seller on the Seller Store on the Website, unless: Offer Made by Seller where you place an Order and make payment for a Product on the Website, you are actually making an offer to purchase the Products from the Buyer, based on the information and description of the Product applicable at the time of purchase.We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the website. As such, we reserve the right to refuse or cancel any order. In the event that an item price is incorrectly, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card or bank account charged.
Malaysia’s Ministry of Finance announced that effective 1 June 2018, the supply of goods and services made in Malaysia, as well as the import of goods and services subject to the Goods and Services Tax (GST) at the standard rate of 6%, will now be subject to GST at zero rate (0%).
TRADEMARKS AND COPYRIGHTS
DCmarket has owns, or is the licensee to, all rights, titles, and interests in and to its applications, including all rights under patent, copyright, trade secret, trademark, or unfair competition law, and any and all other proprietary rights, including all applications, renewals, extensions, and restorations thereof. Members will not modify, adapt, translate, prepare derivative works from, decompile, reverse-engineer, disassemble, or otherwise attempt to derive source code from the Application and will not remove, obscure, or alter the Company’s copyright notice, trademarks or other proprietary rights notices affixed to, contained within, or accessed in conjunction with or by the application.
CANCELLATION, RETURN AND REFUND
Buyers may cancel purchases at any time before shipment. Once shipped, purchases will be subject to return process rather than cancellation process. Buyers may request for return of purchased items at any time within 3 days from the date of receipt. Dcmarket will hold the payment until the case is solved. With respect to return-related matters, relevant laws and regulations shall prevail over the terms and conditions suggested by sellers. Return fees shall be responsible by the party attributable to the return request, example: Buyer, where the return is due to his/her change of mind; and- Seller, where the return is due to the defects in the item, delivery delay or delivery of the wrong or different item.
For overseas purchases, return attributable to the buyer may not be practically possible due to high return charges costs. We or sellers are no responsibility and assume no liability for such cases. Upon completion of the cancellation or the return process, the Company shall refund by immediately canceling the credit card transaction authorization in case of payment by credit card or by depositing the amount paid by the buyer in the account of the buyer in case of payment by cash. Buyers may at any time request to withdraw from the account of the buyer and the request amount shall be remitted to the buyer’s bank account within 2 business days.
The Company shall have the right to cancel any orders & transactions where the Company deems it necessary to:-
- To ensure compliance with the law;
- Protect the interests of the Company, Seller, Buyer and/or any relevant third party; and/or
- Such other reason as the Company deems appropriate.
The Company may commence refund procedures without any request made by both Buyer and Seller shall be notified of the cancellation in writing.
A Buyer shall be entitled to a refund or exchange of a Product in the following situations:
Product is defective
A Product is faulty if:
- Is unfit for its anticipate use
- Design has a defective
- Has been defectively assembled or manufactured and/or
Product does not supply with description or criteria
A refund or exchange is allowed if the delivered Product:
- Received a different or the wrong product;
- It has different specifications from that advertised, such as different function, wrong colour or size;
- It has missing part or promised
Sellers may list their items on our dcmarket website for international or cross-border trading and it is important that all listings and transactions comply with applicable laws. Sellers are responsible for ensuring that their transactions are lawful in both the country of the seller and the country of the buyer. We strongly to encourage sellers to learn about the laws in their own country as well as the country where they’re planning to do the business. Also, Sellers should make sure that the item they’re selling can be lawfully posted outside of the country where they live and also make sure that they can lawfully import the item into the buyer’s country before shipping. Sellers should be consulting possible export and/or import problems with potential buyers, do beware of research, and hire an expert if necessary to make sure that all transactions completely with all applicable laws. Sellers may help ensure compliance with applicable laws by following these listing practices:
- – State on the item detail page that you’ll only ship your items to the countries which legally allow the items to be imported.
- – Include a clause in the item detail page describing any limitations on the items. For example, “No shipment to Korea or any.”
We do not charge buyers any fees for purchasing and bidding on listed items and we do not charge sellers any insertion or listing fees. We do charge sellers fees (excluding GST) on item selling price for completed transactions.
SHIPPING & DELIVERY INFORMATION
On receipt of the payment from the buyer, the Company shall instruct the seller to take necessary actions for delivery and the seller should ship and enter delivery information including the name of the delivery company, the tracking number, etc. within 3 business days from the date of the delivery instruction. If the seller fails to do so, the Company may cancel the transaction order and should not be responsible any or liable for any loss or damages to the seller due to such cancellation.Sellers shall take all reasonable actions for buyers to receive purchased items within the time period specified by the seller on the item detail page.But the Seller fails to deliver the Product within the period specified on the Product page without any proper, reasonable and acceptable justification, you may request for the Transaction to be cancelled. (such as delivering to the wrong address), the seller shall bear all liabilities relating thereto. If any transaction is cancelled due to a reason attributable to the seller (e.g. non-delivery of the purchased items), the Company may take actions against the seller.In such instance, the Company shall refund any payment made by you in accordance with the Cancellation, Return and Refunds Policy in force at such time. We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We get your information only as described in our system used. We view and protection of users’ privacy as a very important community principle.
Also, we store and process your information on computers that are protected by physical as well as technological security devices. You can access and modify the information that you provide us and choose not to receive certain communications by signing-in to your account. We use third parties to verify and certify our privacy principles. If you object to your Information being transferred or used in this way please do not use our services.
For the avoidance of doubt, if Double Click Global Sdn Bhd has reasonable grounds to believe that any User is in breach of any of the terms of this Agreement, Double Click Global Sdn Bhd will reserves the right, in its sole and absolute discretion, to cooperate fully with governmental authorities, private investigators, all the rightful owner(s) or interest holder(s) and/or injured third parties in the investigation of any potential or ongoing criminal or civil doing wrong.
Furthermore, Double Click Global Sdn Bhd may disclose the User’s identify and contact information, such other transaction-related data, if requested by a government or law enforcement body, private investigator, rightful owner or interest holder and/or any injured third party or as a result of a subpoena or other legal action, or if Double Click Global Sdn Bhd is of the view, in its sole and absolute discretion, that it would be in its best interest to do so. Double Click Global Sdn Bhd shall not be liable for damages or results arising from such disclosure, and the User(s) agrees not to bring action or claim against Double Click Global Sdn Bhd for such disclosure.
- Date of release payment to seller weekly/monthly
- Merchant is authorised to collect payment on behalf of sellers
- Seller agrees not to sell Drugs, Weapons, etc “sensitive items basically”
PAYMENT RELEASE FOR SELLER
- By selling on DCmarket, the sellers agree to authorised the merchant to collect the payment on behalf of sellers, and payment shall be released to sellers by the end of each month or longer.
In most situations, DCmarket pays you every two weeks. Each payment includes 14 days of your orders (less DCmarket’s fees) that were delivered at least 7 days ago.
DCmarket pays proceeds out 7 days after the latest estimated delivery date because they value customer satisfaction Holding your payouts for some time allows your buyers to assess their orders for any issues.
If a customer is dissatisfied and asks for a return within that 7-day window, it will be processed from the funds that DCmarket has on hold.
The actual dates of each payout will depend on when you signed up as a seller. This means that Dcmarket doesn’t necessarily initiate payments on the 1st and 15th of each month like some platforms do.
